Single Status Consultation Package Questionnaire

Following requests from our members for help, below are suggested answers to the BCC questionnaire on the Single Status proposals. Some of the questions are requesting specific answers concerning your school. We have left these unanswered as they will differ between schools. Comments are written in bold and italics.

If you require any further information or assistance then please contact your GMB Birmingham representatives on Tel: 0121 675 8036 or E Mail: gmb.cypf@birmingham.gov.uk

SINGLE STATUS CONSULTATION PACKAGE QUESTIONAIRE

We hope you find the attached Single Status Consultation Package interesting.  We are very interested in your views and would ask if you could complete and return this form by 30 November 2008.  The results of this consultation will then be tabulated and shared amongst all the school community.  The details in the package are proposals only at this stage and that is why we need your views.   We will want to amend the package in the light of the views received.  We will try to accommodate as many views as possible subject to the constraints of available finance and relevant employment and education legislation.  We are consulting with a wide range of audiences including Schools Forum, Governors, Headteachers, Trade Unions and individual members of staff and it will therefore be difficult to accommodate all views in the final version that the City Council will be recommending for adoption in schools.

There are a number of specific issues that have been raised in discussions and again we would like your views

Specific Issues

Agree

Disagree

1.      Do you have staff who work a split shift?

(An example of split shift is an employee working in the morning  for three hours, having a break and recommencing work at 4 pm for a further three hours).

If yes, do you believe they should be recompensed for this working pattern?

Please provide succinct reasons for your views

I understand that there is an allowance for staff that do split duty I believe that this should be paid to all that do this as part of their role

No

2.      Does your school have a medication policy?

Do support staff administer medication to pupils?

If you do think this ‘duty’ should receive a payment ? For an example in a similar manner to that of a first aid allowance (£140).

Please provide reasons for your view

This is an extra responsibility that should be rewarded at a level significantly greater than £140 more in line with the level 2 responsibility payments

If you do agree with an allowance payment, at what level?   Yes At Level 2 responsibillty point or SEN allowance

3.      Are your support staff required to attend residential trips?

If yes, on a voluntary or requirement basis

Do you provide any additional payment to them for this?

If yes, please detail the arrangements made

Would you support a policy of no additional payment for residential trips?

Please provide succinct reasons for your views?

All hours worked should be paid, in line with employment law, these are employees not voluntary workers. Where there may be duties to perform at night, a sleep in allowance should also be paid in line with other staff in BCC.

4.      Do you employ HLTA’s?

If yes, how many hours do they spend undertaking ‘whole class duties’?

The HLTA duties are a lot wider than just “whole class duties”.

Yes

No

5.      (a) Do you agree with the suggestion to cease the Technician allowance

(b) Or to consider the qualification at assimilation and to consider the qualification at appointment in the future.

If no, please explain

This a nationally agreed allowance, there is no good reason to remove it.

No

6.      Please list who holds the keys for your school

1)

2)

3)

4)

Do you expect those to hold the keys as part of their duties?

Is this reflected in their respective job descriptions?

Are you of  the understanding this duty is reflected in their pay?

There are a number of people that may hold keys on a temporary or permanent nature, this is not reflected in the persons JD. In this situation an additional payment for this responsibility is appropriate.

7.      SEN allowance is only paid to special schools, would you support this being extended into mainstream schools?

Please provide succinct reasons for your views?

Through the inclusion process there are large numbers of pupils with SEN integrated into mainstream schools. Where a member of staff’s prime role is to support children with special needs then it would be correct to pay the SEN allowance.

Yes

8.      Under the Annual Leave pro-rata arrangements, some

employees may experience a reduction in leave, and therefore in pay.  The trade unions favour protecting the pay.  What is your view?

a) Would you rather protect current pay?

or

b) Protect the annual leave entitlement?

Yes

No

9.      Do you have employees working ‘banked hours’?

Is this a local arrangement?

The trade unions have requested that ‘normal‘ banked hours are credited during sickness rather than the standard hours – would you support such a change?

Yes

Yes

No

No

10.  Lunchtime Supervisors accrue retainer pay during the

school holidays, as do catering employees employed directly by the City Council, would you support ceasing such a payment for LTS?

Please provide succinct reasons for your views

This payment was introduced to retain the employment of supervisors on low hours and therefore pay, the removal will result in losing staff and an inability to recruit into these positions.

No

11.  Education legislation broadly enables schools to set the pay of their staff.  The trade unions have asked for school staff:

a) to have a mandatory right to take any appeal against that grading to the City Council’s appeals process.

b) the current proposal as set out in the proposed package is for governors to have the option to refer appeals for job evaluation and be bound  by the results.

Which process would you prefer a) or b)?

Please provide reasons if applicable.

The City Council are the guardians of the JE scheme, they have the knowledge and expertise to deal with the appeals. Passing this responsibility to the governors of each individual school will result in a lack of consistency and therefore fairness in the process. This will make a mockery of Single Status.

a)

12.  The trade unions have asked that the effective date for School Single Status be backdated to April 2007, similar to centrally managed staff and the national agreement.  Implementation is unlikely to take place before April 2009, it is proposed to backdate to April 2008 but with protection also starting in April 2008. Backdating pay will have serious implications for schools when planning their budgets.

Do you agree this proposal ?

Please provide further comment

There are 2 proposals above, I agree with the Trade Union proposal, in line with the rest of the authority and the NJC national pay agreement.

yes

Please let us know if you have any general comments on the package:

It is important to treat schools staff equally with the rest of the authority.

Any reduction in pay or conditions for these staff will result in a negative affect on the education of the children of this city. I am a GMB member and expect you to negotiate with my elected representatives.
